To People’s Governments of all counties and districts, Management Committees of all Development Zones (New Districts) and departments of the Municipal People’s Government,

Opinions on Implementation of Temporary Livelihood Assistance for Urban and Rural Residents with Financial Difficulties in Nanchang City has been approved and adopted at the 25th Standing Meeting of the Municipal Government on July 29, 2008. And now it is to send to you, please carry out it carefully and earnestly.

        

Opinions on Implementation of Temporary Livelihood Assistance for Urban and Rural Residents

with Financial Difficulties in Nanchang City

In order to properly solve the temporary livelihood troubles of the urban and rural residents with financial difficulties and to constantly improve the urban and rural social assistance system, comprehensively arrange the work, focus on key points, establish and formulate rules and regulations, regulate implementation and conscientiously improve the capacity to give proper assistance to the masses with financial difficulties caused by temporary emergencies. According to the spirit of the Notice on Establish and Improve the Temporary Assistance System for Urban and Rural Residents with Financial Difficulties Issued by the General Office of Jiangxi Provincial People’s Government (GFTF [2008] No. 31), and combining with the practical conditions of our city, the opinions on implementation of relevant work are put forward as follows:

I. Guiding Ideology

Following the important thought of Three Represents and the spirit of the Seventeenth National Congress of the Communist Party of China and starting from implementing a Scientific Concept of Development and building a harmonious socialist society, fully realize the important role played by the temporary assistance system in the construction of social assistance system, conscientiously adopt powerful measures to intensify the implementation of the policies in accordance with the principle of “open policies, normative procedures, perfect systems and transparent results”, so as to make all urban and rural masses with financial difficulties caused by temporary emergencies be given timely effective assistance. Gradually improve the subsistence allowances system so as to match the temporary assistance, improve the work mechanism combining government assistance with social assistance and constantly increase the overall level of the social assistance. 

II. Target Tasks and Basic principles

 (I) Target tasks. From Jan. 2008, the temporary assistance system shall be established to give temporary assistance for the urban and rural households enjoying the subsistence allowance and households close to the subsistence allowance with financial difficulties because of temporary emergencies and to help them solve major difficulties. The temporary assistance system shall be listed in the people’s livelihood engineering appraisal and shall be constantly summarized and improved, so as to gradually achieve the targets of institutional management and standardized operation.  

 (II) Basic Principles. The temporary assistance system for urban and rural residents with financial difficulties is to give non-scheduled, non-quantificational livelihood assistance system for the families with temporary financial difficulties due to temporary emergent accidents occurred in daily life. 1. Stick to the principle of “help the needy and relieve the distressed”; 2. Stick to the principle of combining government assistance and social interaction with help from relatives and friends; 3. Stick to the principle of “just, fair and open”; 4. Stick to trying to do the best within the capacity; and 5. Stick to the principle of combining hierarchical responsibility with localized management. 

III. Subjects of Assistance

All urban and rural residents with permanent household register in our city who conform any of the following conditions shall apply for the temporary assistance:

 (I) The urban and rural households enjoying the subsistence which have severe financial difficulties because of disease, disasters (non-natural disaster) or suffering from emergent accidents; 

 (II) The urban and rural households (refer to the households with average monthly income standard lower than 120% of that for enjoying the subsistence allowance) close to the subsistence allowance beyond the scope of coverage of urban and rural subsistence allowance system and other special assistance systems which have suffered temporary financial difficulties because of disease, disasters (non-natural disaster) or suffering from emergent accidents; and

 (III) Other groups with special difficulties who shall be given assistance deemed by the county-level (district-level) People’s Governments.

The assistance for the social disasters caused by such natural disasters as valley flood, drought, hail, etc., by large area of environmental pollution and destructive disasters and by force majeure shall be treated as according to the treatment methods used in testament of major natural disasters.  

Any of the following conditions shall not be given any temporary assistance:

 (I) Where the families with financial difficulties cased by such reasons as fight, traffic offences, excessive drinking, gambling, etc.

 (II) Where the members of households fail to offer the real family conditions and resort to deception and reject the investigation of the administrative institutions; and

 (III) Other personnel shall not be given assistance deemed by the county-level (district-level) People’s Governments.

 (IV) Assistance Standard

The concrete standards of temporary assistance shall be determined by the county-level (district-level) People’s Governments based on such factors as local economic development level, fiscal conditions, assistance contents, assistance types, labor capacity of the assistance subjects, difficulty degree suffered by the subjects, etc. When determining the assistance standards, all counties (districts) shall formulate different standards according to different types of applicants. The following instructions shall be followed at present:

1. As for the urban and rural households enjoying subsistence allowance which have suffered from temporary severe financial difficulties because of severe diseases, and still fail to make a living after being given all other assistance, the maximum assistance thereof shall not exceed 2000 Yuan;

2. As for the urban and rural households enjoying subsistence allowance which have suffered from severe financial difficulties because of disasters (non-natural disasters) or suffering from emergent accidents, the maximum assistance thereof shall not exceed 4000 Yuan;

3. As for the urban and rural households close to the subsistence allowance which have suffered from temporary severe financial difficulties because of severe diseases, and still fail to make a living after being given all other assistance, the maximum assistance thereof shall not exceed 1000 Yuan; and

4. As for the urban and rural households close to the subsistence allowance which have suffered from temporary severe financial difficulties because of disasters (non-natural disasters) or suffering from emergent accidents, the maximum assistance thereof shall not exceed 2000 Yuan.

The temporary assistance standards shall be adjusted with the economic development and enhance of the people’s living standard.

V. Procedures for Application, Check and Approval

The temporary assistance application shall be submitted by taking household as the unit. In the implementation of the temporary assistance, work hard according the principle of “four open items” which refers to the open of policies, subjects, standards and amounts, and according to the principal of “three announce items” which refers to announce of application reasons, check opinions and approval results, and accept the extensive supervision from the masses and society. 

 (I) Where any families are to apply for temporary assistance, the heads of the households shall offer written applications to the local town-level (street-level) People’s Government, offer according to the facts the household registers, identity cards and Subsistence Allowance Certificates if any, the households close to the subsistence allowance shall also offer certificates of income, certificates of help from working units and society and other effective certificates which can prove the difficulty degree. In case of any emergent accidents, certificates thereof or on-site witness materials shall also be submitted. 

 (II) The town-level (street-level) People’s Government shall conduct check on the actual living standard and economic conditions of the households of the applicants within 5 working days upon receiving the application materials. The Sheet on Approval of the Temporary Assistance for Urban and Rural Residents with Financial Difficulties in Nanchang City shall be filled in by the towns (streets) governments. After giving preliminary opinions, the sheets together with the certificate materials shall be submitted to the county-level (district-level) civil administration departments. 

 (III) County-level (district-level) civil administration departments shall conduct check within 3 working days upon receiving the reported materials. As for the conforming families, notify the town-level (street-level) People’s Governments to put up notices and publish such assistance at the local villages or neighborhood committees. In case of no objection, all the approved assistance funds shall be given the households which have applied such assistance. As for the nonconforming households, notify the same to the applicants and give reasons thereof. 

The check and accounting for the family incomes of the urban and rural households close to the subsistence allowance which have applied for the assistance, the Methods on Minimum Living Guarantee for the Urban Residents of Nanchang City (No. 100 order of Nanchang Municipal People’s Government), the Notice on Establishment of Minimum Living Guarantee System in Rural Area formulated by (HMF [2006] No. 199) formulated by the Municipal Civil Affairs Bureau and the Municipal Finance Bureau and the methods on evaluation of income formulated by the counties (districts) shall be subject to in execution.

As for the households enjoying the subsistence allowance and households close to the subsistence allowance whose family members have suffered severe diseases, the check thereof shall be executed subject to the Opinions on Further Improving the Implementation of Urban and Rural Assistance System Issued by Nanchang Municipal Civil Affairs Bureau and Nanchang Municipal Finance Bureau (HMZ [2008] No. 56).

VI. Funds Procurement and Management

1. Fund procurement. The temporary assistance funds shall mainly be put in by the government, supplemented by social donations. To ensure the long-term and successive operation of the temporary assistance funds, the municipal and county-level (district-level) finance had raised assistance funds respectively according to the standard of 0.12 Yuan/person/year and 0.24 Yuan/person/year in 2008 and bring such funds into annual fiscal budget. Hence force, the funds input shall be gradually increased as the economic growth. Encourage social organizations and individuals to offer donations for temporary assistance. The donated funds shall be brought into accounts of temporary assistance funds for special use.

2. Funds management. Set up temporary assistance funds, conduct fiscal special management, special accounting and earmark the funds for its specified purposes only. The annual balance funds can be transferred to the next year for the same purposes, which shall not be used for balance the budgets or used for other purposes. In case the conditions permit, it shall realize the socialized delivery of the temporary assistance funds, the use conditions of the temporary assistance funds shall be announced to the public and accept the supervision from society.

VII. Job Requirements

(I) Raise awareness and intensify the leadership. Governments at all levels shall, from the view of carrying out the spirit of Seventeenth National Congress of the Communist Party of China, deeply implementing the Scientific Concept of Development and construction of harmonious socialist society, be fully aware of the important function of the establishment of temporary assistance system in the construction of social assistance system, conscientiously intensify the leadership on construction of the temporary assistance system, place it on important agenda, bring it into the overall planning on construction of social assistance system and list it in contents for appraisal of the people’s livelihood engineering work. According to the standards as required in construction of public finance, bring the temporary assistance funds into fiscal budgets and gradually increase in amount. Discuss and solve the difficulties and problems encountered in the temporary assistance in time, explore and establish the temporary assistance systems suitable for the development of the social market economy and conforming to the needs of the urban and rural masses with financial difficulties. Extensively propagandize the temporary assistance policies, mobilize the social forces to participate in the temporary assistance work and develop the traditional virtues of the Chinese nation on caring for the needy and those with extreme difficulties in the whole society. 

 (II) Clear define the responsibilities and work hard on implementation. The civil administration departments shall be responsible for the management and approval of the temporary assistance; the financial department shall be responsible for arrangement of the fiscal funds of the current level in accordance with the planned budget; the audit department, supervisory department and other departments shall be responsible for the supervision and auditing on the use condition of the urban and rural temporary assistance funds.  

(III) Intensify supervision and regulate management. The temporary assistance shall be based on the principle of “just, fair and open”, stick to democratic appraisal and display system, accept the extensive supervision from society; as for the units or individuals which gain the temporary assistance funds by cheating and deceit and/or submit false certificates, their qualification for the application of assistance for another time in the same year shall be cancelled and false funds and objects shall be replevied; as for the institutions and personnel which handle the temporary living assistance by breach of duty, practicing favoritisms and committing irregularities, abusing their authorities by breach of regulations, such institutions and personnel shall be investigated and affixed for their liabilities; as for the responsible personnel with a serious nature which may constitute crimes, such personnel shall be investigated and affixed for corresponding legal liabilities according to law. Work hard on the archives management pertaining to the temporary assistance, establish temporary assistance material archives, implement one archive for one household and realize 2-layer management respectively by counties (districts) and towns (streets). Intensify the participation and supervision of the residents, so as to ensure the open polities, normative procedures, complete systems and transparent results of the temporary assistance.

 (IV) Work hard on connection and ensure the efficiency. Earnestly focus on the characteristics of the temporary assistance. Accurately grasp the relations between the temporary assistance system and the subsistence allowance and other special assistance system. Intensify the connection of all assistance systems, so as to give display for the comprehensive effect of the social assistance. Try to explore the assistance modes combining offering cash and objects with providing services, constantly summarize and promote such experience and measures as “charity supermarket” and “love supermarket”, form a characteristic, connected and good-interaction operation mechanism between temporary assistance and charity undertakings, ensure all social assistance policies be carried out, so as to make sure that the living of the masses shall be effectively guaranteed.

All counties (districts) may formulate the specific implementation details by taking their actual conditions into consideration.
