(I) Carry out the Party’s and the national guidelines, policies, laws and regulations on labor and social security; perform the duties given by Labor Law of the People’s Republic of China; study and formulate the detailed guidelines, policies and reform schemes on labor and social security in the city; formulate the development planning and the annual plans for labor and social security work in the city, and organize their implementation.
(II) Draft the local rules and regulations and regulatory documents concerning labor and social security work; study and formulate the local labor standards and basic norms; manage the institutions of consultative services in labor and social security policies in the city; enforce the supervision over and inspection of national labor and social security; supervise the work of labor and social security supervision and inspection institutions in county and district.
(III) Make overall plans for the development and utilization of labor force resources and labor employment in the city; draft the basic policies and measures on promotion of urban and rural employment; plan the development of labor market in the city; organize, establish and improve the employment service mechanisms; draft the planning and policies for the diversion, subsistence allowances and reemployment of laid-off workers of state-owned enterprises; organize and implement the re-employment projects; formulate the administration rules for job introduction agencies, and organize their implementation; formulate the policies and measures on development and employment of surplus rural labors and orderly flow of rural labor, and organize their implementation; manage foreigners working in Nanchang in accordance with labor division; comprehensively administer the appointment of Chinese employees by relevant institutions to foreign enterprises’ representative offices in Nanchang and labor force employment agency, consultation and training business by foreign enterprises’ offices in Nanchang; manage the bilateral and multilateral international exchanges and cooperation projects among governments, non-governmental organizations and international aid agencies in the field of labor and social security and technical cooperation and talent exchange of foreign business.
(IV) Carry out the occupational classification, national vocational skills standard and industry standard; implement professional qualification certificate system; take charge of worker technical class appraisal and professional skill verification in the city; formulate the development planning and management rules for technical schools in the city under the guidance of national educational guidelines and policies; formulate the rules and policies for on-job skill training for employees, re-employment trainings for the unemployed and laid-off workers, employment training centers and vocational training institutions set up by non-governmental organizations; formulate the rules and regulations for cultivation of talents with professional skills, commendation, reward and professional skills competitions; formulate the implementation measures on vocational training system in the city, and organize their implementation.
(V) Formulate the implementation measures in accordance with national basic rules concerning labor relation adjustment, and organize their implementation; formulate the implementation standards for labor contract and collective contract, relevant rules for labor dispute arbitration and basic norms for rewards and punishment to employees by enterprises, and organize their implementation; comprehensively administer the handling of labor disputes; verify and release local standards for enterprise manpower and labor quota; carry out and supervise the working hours of enterprise employees, rules for rest and vacation, employee welfare system and special labor protection policies for female workers and workers under the age of eighteen; take charge of the policy allocation and deployment; participate in evaluation of enterprise working model at city level.
(VI) Carry out the national macro adjustment and control policies concerning enterprise employee wage, industry wage income adjustment policies and state-owned enterprise operator income distribution policies; draft the specific implementation measures; carry out the standards for minimum wages and talent minimum income standard; draft relevant policies on enterprise wage guide line; verify the gross pay of municipal enterprises and wage standards of major principals; formulate and release the wage guiding price in labor market; give guidance to collective consultation of enterprise wages; review wage agreements according to laws.
(VII) Comprehensively administer the social security work in Nanchang; draft, organize, implement, supervise and inspect the development planning, reform schemes and implementation measures on pension, unemployment insurance, medical insurance, workplace injury insurance and maternity insurance.
(VIII) Formulate the specific implementation measures on the collection, payment, management and operation of social security funds; give opinions for the examination and approval of annual social insurance budgets and final accounts; exercise administrative supervision over the management of social security funds; formulate management rules for social security agencies and qualification standards for operational institutions of social security funds; work out planning for the construction of social security service system, and organize their implementation; formulate qualification examination measures for designated medical institution and appointed retail drugstore in company with the departments concerned, and organize their implementation.
(IX) Formulate the planning and policies for complementary pension and complementary medical care insurance in organs, public institutions and enterprises; review and approve the qualification of institutions to undertake complementary insurance business.
(X) Take charge of approval on employee retirement, early retirement and resignation of pension unified accumulation units; employee industrial injury assertion and authentication of degree of employee disability which is not caused by work-related injury or occupational disease.
(XI) Take charge of the statistics and information concerning labor and social security; organize and establish information network of labor and social security; regularly release statistical communiqué, information material and development forecast report of labor and social security in Nanchang.
(XII) Organize the scientific research, application of research findings and industry development work in the field of labor and social security.
(XIII) Guide and coordinate the implementation of the labor and social security work at county or district level (including street and town); undertake other duties assigned by the municipal government.
