Registration of Adoption of Children

Organ of Transaction
   For the adoption by Chinese citizen, the registration is at the office of civil affairs at the country (Municipal or district) level.
For the adoption by residents from Hong Kong, Macao and Taiwan, and overseas foreigners, the registration is at the office of civil affairs at the municipal or district level.

Time Limitation
   The adoption registration authority, after the receipt of the application for adoption registration shall check the relevant information within the 30 days since the next day when the application is received. For the applicant who has met the requirements of the adoption law, the adoption registration authority shall transact the adoption registration and issue the adoption registration certificate (The days for announcement shall be not included in the registration period). For the applicant who has failed to meet the requirements of the adoption law, no registration is allowed and the reasons shall be given to the applicant.

Qualifications
   1. The adopters shall meet simultaneously the following requirements: (1) Childless; (2) Capable of rearing and educating the adoptee; (3) Suffering no such disease as in medically regarded as unfit for adopting a child; and(4) Having reached the age of 30.
   2. The following citizens or institutions shall be entitled to place out children for adoption: (1) guardians of an orphan; (2) social welfare institutions; or (3) parents unable to rear their children due to unusual difficulties.
   3. The minors under the age of 14, as enumerated below, may be adopted (1) orphans bereaved of parents; (2) abandoned infants or children whose parents cannot be ascertained or found; or (3) children whose parents are unable to rear them due to unusual difficulties.

Materials for Application
   For the adoption by Chinese citizen, the adopters shall submit the adoption application and the following proofs to the adoption registration authority:
   (1) The residency paper and identification card of the adopter.
   (2) The proof issued by the employer unit or village (neighborhood) commission of the adopter on proving the marital status, the children information and the capacity of the adopter on raising and educating the adoptee.
   (3) The proof of health examination issued by the hospital above the county level.
   (4) For the adoption of the abandoned infants or children under the care of social welfare institutions, the adopter shall submit the proof of fertility issued by the family planning department where the adopter often resides.
   (5) For the adoption of the abandoned infants or children under the care of social welfare institutions whose own parents cannot be ascertained and found, the childless proof of the adopter issued by the family planning department where the adopter often resides and the abandoned infants or children report certificate issued by the public security organs shall be submitted;
   (6) For the adoption of stepson or stepdaughter, residency paper, identification card and marriage certificate between the adopter and the biological father or biological mother shall be submitted.
   For the adoption by Chinese citizen, the persons having placed out a child shall submit the following proofs to the adoption registration authority
   (1) Residency paper and identification card of the persons having placed out a child (In case the guardian is an organization, the identification card of the person in charge shall be submitted).
   (2) The guardian shall obtain the consent of the person who has obligations to support the orphan and submit the written statement on the approval of placing out a child for adoption.
   (3) In case the social welfare institution is the person placing out of the child for the adoption, the original record on the abandoned infant or child to the social welfare institution and the abandoned infants or children report certificate issued by the public security organs shall be submitted; in case of orphans, the death certificates of both biological parents or the certificates of the declaration of death of both biological parents shall be submitted.
   (4) In case the guardian is the person placing out of the child for the adoption, the certificate that the certificate of liability of guardian shall be submitted; in case of orphans, the death certificates of both biological parents or the certificates of the declaration of death of both biological parents shall be submitted; and the certificate that the biological parents of the adoptee have no full capacity for civil acts and severely impair the child shall be submitted.
   (5) In case the biological parents are the person placing out of the child for the adoption, the agreement entered with the local family planning department on the compliance with the regulations on family planning shall be submitted.
   (6) In case the biological parents are unable to rear them due to unusual difficulties, resulting in that the child has to be placed out for adoption, the certificate on proving the particular difficulties of the person placing out of the child for the adoption issued by the employee unit or the village (neighborhood) committee shall be submitted. Where the child is raised by only one parent when the other parent cannot be ascertained or died, the certificate on the death of the spouse or the missing evidence shall be submitted; In case the adoption of a child of collateral relative by blood of the same generation and up to the third degree of kinship, the certificate on the relation by blood between the child and the adopter issued by the public security department or subject to the notarization shall be submitted.
   (7) Where a disabled person is to be adopted, the disability certificate issued by the hospital above the county level shall be submitted.
   For the adoption by Overseas Chinese or the resident from Hong Kong, Macao or Taiwan, the adopters shall submit the adoption application and the following proofs to the adoption registration authority:
   (1) For the overseas Chinese living in the country where has established the diplomatic relations with China, it requires to submit the adoption application; the passport; the certificate on proving the age, marriage, child, occupation, property, health, criminal punishment and other information of the adopter issued by the authority of the country where the adopter lives, the certificate shall be subject to the certification of the Office of Foreign Affairs or the authorized agent of the country where the adopter live and shall also subject to the certification of the Chinese Embassy in the country.
   (2)For the overseas Chinese living in the country where has not established the diplomatic relations with China, it requires to submit the adoption application; the passport; the certificate on proving the age, marriage, child, occupation, property, health, criminal punishment and other information of the adopter issued by the authority of the country where the adopter lives, the certificate shall be subject to the certification of the Office of Foreign Affairs or the authorized agent of the country where the adopter live and shall also subject to the certification of the Embassy of the country with the diplomatic relations with China.
   (3) For the resident from Hong Kong, Macao or Taiwan, it requires to submit the adoption application; for the resident from Hong Kong or Macao, the identification card valid in Hong Kong or Macao, the Mainland Travel Permit or the home return permit; for the resident from Taiwan, the valid documentary proof of residence from Taiwan area and the valid travel permit issued or endorsed by the competent national authority; the certificate of Hong Kong notary commissioned by the competent national authority (For resident from Macao, the certificate issued by the competent authority; for resident from Taiwan, the certificate notarized by a notary organization), the content of the certificate is to prove the age, marriage, child, occupation, property, health, criminal punishment and other information of the adopter.

Flow
   The adoption registration authority shall be responsible for reviewing the adoption applications and relevant supporting materials submitted by the adopter to the adoption registration authority. For the abandoned infants and children whose biological parents cannot be ascertained or found, the adoption registration authority shall post the notice to find the parents before the registration, where the abandoned infants and children are not claimed by their biological parents or other guardians60 days after the notice, it shall be deemed that the biological parents of the abandoned infants and children are unable to be found. The duration for notice shall not be included into the time for registration.
